Terms and Conditions
1. PAYMENT TERMS
1.1 Advance Payment
Upon confirmation of order, 50% of the total order value must be paid as advance. This payment confirms your booking and initiates the production/allocation process.
1.2 Balance Payment
The remaining 50% payment must be cleared in full before the dispatch of products from our facility. Products will not be released for shipping until complete payment is received.
1.3 Taxes & Additional Charges
All quoted prices are exclusive of taxes.
- 12% GST will be added to the product value.
- Any other applicable taxes or duties shall be borne by the client.
- Prices are subject to change without prior notice for future orders.
1.4 Payment Methods
Payment can be made through bank transfer, cheque, or other approved methods. Payment details will be provided upon order confirmation.
2. DELIVERY & LOGISTICS
2.1 Shipping Costs
All delivery and logistics charges are the sole responsibility of the client and will be calculated based on:
- Delivery location
- Order size and weight
- Mode of transportation selected
- Current shipping rates
2.2 Delivery Timeline
- Estimated delivery schedules will be communicated at the time of order confirmation.
- Timelines are subject to production schedules and availability.
- Any delays due to unforeseen circumstances will be promptly communicated.
2.3 Delivery Process
- Products will be properly packed for safe transit.
- Tracking information will be provided where applicable.
- Risk of loss transfers to client upon handover to logistics partner.
3. RETURNS, REFUNDS & EXCHANGES
3.1 No Refund Policy
Baha Games operates on a strict no-refund policy. Once an order is confirmed and advance payment is received, refunds will not be entertained under any circumstances.
3.2 Exchange Policy
Products will be exchanged only in the following situations:
- Transit Damage: Physical damage occurred during shipping
- Manufacturing Defects: Defects identified upon delivery
- Wrong Product: If incorrect product is delivered
3.3 Exchange Process
- Report issues within 24 hours of delivery
- Provide photographic evidence of damage/defect
- Original packaging must be retained
- Exchange subject to inspection and approval
- Logistics costs for exchange may apply based on circumstances
4. WARRANTY & SERVICE
4.1 Product Warranty
All products are sold on an "as-is" basis without any warranty.
No implied warranties of merchantability or fitness for particular purpose.
Natural wood variations are not considered defects.
4.2 Service & Maintenance
Post-sale servicing is available upon request.
Service charges will include:
- Technician fees
- Replacement parts (if any)
- Two-way logistics costs
- Any other actual expenses incurred
Service quotes will be provided before work commences.
5. CLIENT RESPONSIBILITIES
5.1 Inspection Upon Delivery
- Inspect all products immediately upon receipt.
- Check for visible damages, missing parts, or discrepancies.
- Verify against order specifications and packing list.
- Document any issues with photographs.
5.2 Reporting Timeline
- Report damages within 24 hours of delivery.
- Report missing items within 48 hours of delivery.
- Late reporting may result in claim rejection.
5.3 Product Care
- Follow provided care and maintenance instructions.
- Ensure appropriate usage as per age recommendations.
- Store products in suitable conditions.
- Regular maintenance is client's responsibility.
6. INTELLECTUAL PROPERTY & USAGE RIGHTS
6.1 Ownership of Designs
All game designs, concepts, and intellectual property remain the exclusive property of Baha Games.
6.2 Usage Restrictions
Clients are strictly prohibited from:
- Reproducing or copying product designs
- Modifying or altering products for commercial purposes
- Manufacturing similar products
- Selling or distributing unauthorized copies
6.3 Authorized Use
- Products are sold for direct use only.
- Commercial rental or resale requires written permission.
- Promotional use of product images requires approval.
7. LIABILITY & INDEMNIFICATION
7.1 Limitation of Liability
Under no circumstances shall Baha Games be liable for:
- Indirect or consequential damages
- Loss of profits or business opportunities
- Personal injury from product misuse
- Damages exceeding the product value
7.2 Indemnification
Clients agree to indemnify and hold harmless Baha Games from:
- Claims arising from product use or misuse
- Third-party claims related to the products
- Damages from unauthorized modifications
- Liabilities from resale without permission
7.3 Risk Assumption
Clients acknowledge that wooden games carry inherent risks and assume full responsibility for safe usage.
8. ORDER PROCESSING
8.1 Order Confirmation
- Orders are confirmed only after advance payment.
- Written confirmation will be provided.
- Production begins post-confirmation.
8.2 Order Modifications
- Changes allowed within 24 hours of confirmation.
- Subject to production status.
- May incur additional charges.
8.3 Order Cancellation
Baha Games reserves the right to cancel orders due to:
- Production constraints
- Payment issues
- Force majeure events
Advance payment will be refunded in such cases.
9. GENERAL PROVISIONS
9.1 Governing Law
These terms shall be governed by the laws of India, with exclusive jurisdiction of Hyderabad courts.
9.2 Force Majeure
Baha Games shall not be liable for delays or failures due to circumstances beyond reasonable control including but not limited to natural disasters, government actions, or supply chain disruptions.
